PEOPLE SHOP TERMS & CONDITIONS

NOTICE

Please read the following carefully. You are offered use of the Service based on the terms and conditions set out below which should be read in conjunction with our Privacy Policy, Conditions of Use and Payment Terms. By using the Service you agree to be bound by these terms and conditions. If you do not agree to these terms and conditions you cannot use the Service.

DEFINITIONS

  • "Associates(s)" means – person, persons or companies registered as such with People Shop.
  • "Customer(s)" means – a person or persons, company or other organisations registered as such with People Shop and or using through a booking with People Shop the Services of Associates registered with People Shop.
  • "E-mail(s)" means - electronic mail received or sent by People Shop, received, created and sent by a member of People Shop, or automatically created and sent on behalf of People Shop.
  • "Job(s)" or "Work" means - work booked via the Website and carried out by Associates on behalf of Customers.
  • "People Shop" means – People Shop Ltd (registered company number: 05780015) whose registered office is at 5 Jupiter House, Cavella Park, Aldermaston, Reading, Bucks. RG7 8NN including where the context so requires, its shareholders, employees, affiliates, associated and contracted persons, companies or businesses supplying services to People Shop.
  • "Service(s)" means - the services and procedures provided/used by People Shop to You including: information, products and services provided by telephone, fax or mail, on the Website and by E-mail further details of which are contained within these Terms and Conditions and elsewhere in the Website.
  • "Suspend(ed)" means - the suspension of the relevant Associate or Customer account with People Shop as a result of which the relevant party will not be able to book or receive bookings for additional jobs.
  • "System(s)" means - the software, hardware, batch programmes, and business and administrative processes (automated or otherwise) that are used by People Shop in order to provide components of the Service.
  • "Third Party" or "Third Parties" means - any person or entity referred to, in the context of these Terms and Conditions, as being other than You and People Shop.
  • "Website" means - the web space, pages, and the contents and graphics contained in such space or pages which are under the editorial control of People Shop including www.peopleshop.co.uk and all associated web pages.
  • "You" means – the Associate and/or Customer, utilising the Services, as the context requires
  • "Your Information" means - any information You provide to People Shop or other users of the Website including information provided during registration, the rating of Associates and any other communications related to your use of the Services or the Website.

1. GENERAL DISCLAIMER OF WARRANTIES

  1. The Website and the Services are provided on an "as is" and "as available" basis and People Shop makes no warranties or representations, whether express or implied, in relation to the Website or the Services, or any goods or services purchased or obtained through an introduction made via the Website or Services, including but not limited to, implied warranties or conditions of completeness, accuracy, satisfactory quality and fitness for a particular purpose.
  2. People Shop makes no warranty that the Website or use of the Services will meet your requirements or will be uninterrupted, timely, secure or error-free.
  3. No warranty is given by People Shop as to results that may be obtained or the accuracy of any information obtained through the Website or the Services or that any defects in the Website or the Services will be corrected and You understand and agree that any material or data obtained through use of the Website or the Services is at your own discretion and risk.

2. DISCLAIMER - CUSTOMERS

  1. No person under the age of 18 years may book or offer Work via People Shop's Website or its Services.
  2. People Shop's services are intended to be utilised wholly within the jurisdiction of the laws of England. As a Customer or an Associate, if you are accessing People Shop's Services from beyond this jurisdiction we have no knowledge of, or responsibility for, the laws in that country and it is the responsibility of both the Associate and the Customer to identify the law that applies and satisfy themselves that they are operating in accordance with that law.
  3. You acknowledge that it is your responsibility to select an Associate and to specify and agree with that Associate the terms of any Work to be performed. People Shop makes no warranty regarding any goods or services purchased or obtained through any introduction or transaction made via the Website or the Services.
  4. People Shop relies on data provided by Customers and Associates to determine which Associates are included in the database accessible via the Website and does not recommend or endorse any specific Associate.
  5. People Shop does not guarantee to provide an Associate suitable for undertaking a Job whether by reason of geographical restrictions or otherwise.
  6. People Shop provides no guarantee that an Associate to whom it has passed a Customer's Job information will contact the Customer.
  7. People Shop cannot and does not accept any liability in respect of any contract or other agreement entered into between the Customer and the Associate. In particular, but without limitation, People Shop accepts no liabilityrelating to the quality or fitness of any Work performed or omitted to be performed by any Associate and accordingly shall not be liable to the Customer for any occurrence resulting from the introduction of the Associate to the Customer including but not limited to any direct, indirect or consequential loss of any kind suffered by the Customer howsoever arising.

3. DISCLAIMER - ASSOCIATES

  1. People Shop relies on Customers to specify and describe their Job requirements. People Shop makes no warranty for the accuracy or completeness of any information provided by the Customer.
  2. People Shop makes no guarantee to refer any Jobs to an Associate.
  3. As the Customer retains the right to modify or withdraw its Job in the absence of a contract or other binding agreement with an Associate, People Shop makes no warranty as to the availability or suitability of a specific Job.
  4. People Shop is not party to any contract made between the Customer and the Associate in relation to a specific Job and accordingly shall not be liable to the Associate for any occurrence resulting from the introduction of the Customer to the Associate including but not limited to any direct, indirect or consequential loss of any kind suffered by the Associate howsoever arising.
  5. As an Associate, you must ensure that you are have legal right to perform the work specified in the Job description and provide the following information to People Shop as a condition of registration: Pay Pal account details, mobile telephone number, E-mail account details, and residence address. In the event of failure to provide complete and accurate information People Shop reserves the right to Suspend the Associate.
  6. As an Associate, you must obtain a Pay Pal account and maintain sufficient funds for payments to People Shop. In the event of failure to provide the appropriate account details or funds People Shop reserves the right to Suspend the Associate.
  7. As an Associate, you agree to pay fees as and when required and accepted by You through your use of the Website and the Services, including but not limited to: Registration Fees, Annual Membership Fees and Booking Fees in accordance with the People Shop Payment Terms.

4. PRIVACY AND INFORMATION EXCHANGE

  1. By accepting this Agreement, You expressly consent to uses and disclosures of Your Information as set out in the People Shop Privacy Policy.
  2. People Shop holds Your Information strictly in accordance with its Privacy Policy.
  3. People Shop will use its reasonable endeavours to forward details of Customers' Job requests to selected and suitable Associates based on the information provided by the Associates. Upon the receipt of payment of the applicable Booking Fee from and acceptance of the Booking Fee by the Associate selected by the Customer will personal contact details be sent to both the Customer and the Associate concerned.
  4. People Shop will make ratings and comments from Customers in relation to historic Jobs available for Customers and other users of the Website.
  5. If for any reason You do not wish any or all of Your Information to be used in the way set out in these Terms and Conditions then please do not use the Services of People Shop.
  6. You may only use contact information obtained from the Website or any information obtained through a People Shop communication for communications relating to specific Job inquiries which have been notified to You via the Service or the Website.
  7. Customers and Associates agree not to use any personal contact information of any other Customer or Associate provided via the Service or the Website for any unsolicited or commercial messages save as expressly authorised by these Terms and Conditions or where expressly authorised by the particular Customer or Associate following adequate disclosure of the purpose(s). In addition, a Customer or Associate agrees to protect and only use such information in accordance with applicable laws and regulations, including without limitation data protection and privacy laws.
  8. In addition, under no circumstances, except as defined in this Section, can a Customer or Associate disclose personally identifiable information about another Customer or Associate to any Third Party obtained as a result of the Services without People Shop's consent and the consent of such other Customer or Associate after adequate disclosure.

5. YOUR INFORMATION

  1. You are solely responsible for Your Information. You agree to provide true, accurate, current and complete information when providing details to People Shop. You agree not to impersonate any other person or entity or to use a false name or a name that you are not authorised to use.
  2. Your Information and your activities on the Website must not, be false, inaccurate or misleading, offensive, menacing, abusive, defamatory, or in breach of copyright, confidence, privacy or any other rights. Your Information must not infringe any Third Party's copyright, patent, trade mark, trade secret or other proprietary rights or rights of publicity or privacy, be fraudulent, be in breach of any applicable laws or regulations (including, but not limited to, consumer protection, unfair competition, anti-discrimination, false advertising), be obscene, indecent or contain pornography.
  3. Your Information must not create liability for People Shop or cause People Shop to lose (in whole or in part) the services of its ISPs or other suppliers. Your Information must not link directly or indirectly to any other website.
  4. To enable People Shop to use Your Information, you grant to People Shop a non-exclusive, world-wide, perpetual, irrevocable, royalty-free, sub-licensable (through multiple tiers) licence to exercise the copyright, trade mark, publicity, and database rights you have in Your Information, in any media now known or not currently known. You also waive all moral rights you have in Your Information to the fullest extent permitted by law.
  5. Your Information may not contain any computer viruses, macro viruses, trojan horses, worms or anything else designed to interfere with, interrupt or disrupt the normal operating procedures of a computer or to surreptitiously intercept, access without authority or expropriate any System, data or personal information. Your Information may not cause the Website to be interrupted, damaged, rendered less efficient or such that the effectiveness or functionality of the Website is in any way impaired.
  6. You hereby acknowledge that People Shop, at its absolute discretion, shall be entitled to edit, modify or remove any part or parts of Your Information which it considers is in breach of any of the provisions of these Terms and Conditions.

6. YOUR OBLIGATIONS

In consideration of People Shop making the Website and the Services available to you, you agree to use the Website in accordance with the People Shop Conditions of Use and that you:

  1. may not submit or tender for Jobs which are prohibited by Law;
  2. are responsible for procuring the necessary equipment and the payment of telephone charges necessary to access the Website and the Services;
  3. accept responsibility for any content you provide on the Website;
  4. agree not to copy, reproduce, modify, create derivative works from, distribute or publicly display any content (except for Your Information) from the Website without People Shop's prior written permission;
  5. agree not to use the Website or the Services for any illegal purpose and in accordance with all relevant laws;
  6. agree not to use the Website or the Services in any manner which constitutes a violation or infringement of the rights of any person, firm or company or the rights thereof (including, but not limited to, Third Party intellectual property rights or confidentiality);
  7. agree that in the event that you have any right, claim or action against any user arising out of the use of the Website or the Service, then you will pursue such right, claim or action independently of, or without recourse to People Shop.

Furthermore, you as an Associate acknowledge that the responsibility to correctly account for any earnings received following the provision of services is personal to you. People Shop accepts no liability to provide any financial information or advise with respect to any income generated as a result of introductions and bookings facilitated by People Shop. People Shop advise all Associates to seek their own independent, qualified financial advice and to comply with all applicable laws, rules and regulations including those of Her Majesty's Revenue and Customs.

7. PEOPLE SHOP'S RIGHTS

  1. People Shop reserves the right to modify or discontinue all or part of, temporarily or permanently, the Website or the Service with or without notice to you and you confirm that People Shop shall not be liable to you or any Third Party for any modification to or discontinuance of the Website or the Service.
  2. People Shop may change the terms and conditions from time to time and shall post such alterations on the Website.
  3. The content, layout and organisation of the Website shall be subject to variation at the sole discretion of People Shop.
  4. In the event of People Shop's publication of the Website being restricted, curtailed or prevented by any law or any other act or thing beyond People Shop's control, People Shop may at any time, notwithstanding anything contained in this Agreement, forthwith terminate this Agreement in whole or in part without incurring any liability to You.

8. INTELLECTUAL PROPERTY RIGHTS

  1. To the extent that all copyright and other intellectual property rights throughout the world in Your Information does not vest in People Shop by operation of law or the other provisions of this Agreement, you hereby grant to People Shop (free of charge) an exclusive, perpetual, royalty-free licence to use such information for any purpose reasonably required for the operation of the Services.
  2. You hereby acknowledge that all present and future copyright and other intellectual property rights subsisting in, or used in connection with, the Website (the "Rights"), including the manner in which the Website is presented or appears and all information and documentation relating thereto is the property of People Shop and nothing contained herein shall be construed so as to transfer any such rights to you.
  3. Without prejudice to the generality of the foregoing, if and to the extent that you own any or all of the Rights, you hereby irrevocably and unconditionally assign the Rights, with full title guarantee, to People Shop for the full period of copyright and all renewals extensions and/or revivals thereof and thereafter in perpetuity, throughout the world.

9. INDEMNITY

  1. You agree to indemnify People Shop forthwith on demand and hold People Shop harmless against any and all expenses, damages and losses of any kind (including reasonable legal fees and costs) incurred by People Shop in connection with any claims, actual or threatened, of any kind (including without limitation any claim of trademark or copyright infringement, libel, defamation, breach of confidentiality, false or misleading advertising or sales practices) arising from the provision of Your Information or from your use of the Website or the Services.

10. LIMITATION OF LIABILITY

  1. Neither party shall, nor shall it purport to, exclude or restrict liability for death or personal injury resulting from the negligence of it or its employees, servants or agents acting in the course of their employment.
  2. You acknowledge that People Shop has no editorial control over the information that can be accessed by using the Website and the Services and that People Shop may not examine your use of the Services or the nature of the information you are sending or uploading. People Shop therefore excludes all liability of any kind for the transmission or reception of such information of whatever nature.
  3. People Shop does not represent that the information contained in the Website or in any communication from People Shop, including but not limited to telephone conversations, E-mails and letters, is accurate, verified, current, comprehensive or complete. They could contain inaccuracies, typographical, human and/or machine errors or omissions. People Shop will not be liable in any circumstances for any direct, indirect, consequential or special damages arising from use of the Website or Services of People Shop. For these reasons users of the Website should not unconditionally rely, or act upon any of the information contained within The Website, and if anyone does so, it will be entirely at their own risk.
  4. E-mails that are automatically generated from information provided by Customers, Associates and Systems are NOT under the editorial control of People Shop. These may be automatically sent un-checked and un-edited by People Shop and therefore they do not necessarily reflect the opinions and/or beliefs of People Shop.
  5. People Shop is not responsible and cannot be held liable for any inaccuracies, the validity, reliability, any falsehoods, misrepresentations, defamatory language or words, libellous statements, fraudulent activities or any other damaging words, sentences or statements contained in the components of E-mails that are not under the editorial control of People Shop.
  6. You agree that, except for death and personal injury arising from our negligence, People Shop shall not be liable in contract, tort, negligence, statutory duty or otherwise, for any loss or damage whatsoever arising from or in any way connected with this contract, including, without limitation, damage for loss of business, loss of profits, business interruption, loss of business information, loss of data, or any other pecuniary loss (even where People Shop has been advised of the possibility of such loss or damage).
  7. Without limiting the generality of Clause 1(e) of this Agreement, Customers agree not to hold People Shop responsible for any damages or other liabilities arising from Work performed by any Associate. People Shop does not and cannot be involved in Customers' dealings with Associates, or control whether or not Associates will complete any Work as agreed and in the event that a Customer has a dispute with one or more Associates, the Customer hereby releases People Shop from any and all claims, demands and damages (direct and consequential) of every kind and nature, known and unknown, suspected and unsuspected, disclosed and undisclosed, arising out of or in any way connected with such disputes.
  8. Save as expressly set out herein, all conditions, warranties and obligations which may be implied or incorporated into this Agreement by statute, common law, or otherwise and any liabilities arising therefrom, are hereby expressly excluded to the maximum extent permitted by applicable law.
  9. While every reasonable care will be taken in respect of information supplied by you, People Shop cannot accept liability for any information placed or omitted to be placed on the Website (whether or not any such liability is occasioned by People Shop's fault or negligence or otherwise).
  10. People Shop cannot and does not guarantee and does not warrant against human and/or machine errors, omissions, delays, interruptions or losses of information or data, infringing any material, or defamation.
  11. People Shop cannot guarantee the day or time that People Shop will respond to any E-mail, telephone or written enquiries or Website form submissions.
  12. Any responses made by People Shop do not purport to be complete and exhaustive.
  13. Without limiting the foregoing, People Shop shall have no liability for any any matter which is beyond our reasonable control including failure or delay resulting from any governmental action, fire, flood, insurrection, earthquake, power failure, riot, explosion, embargo, strikes whether legal or illegal, labour or material shortage, transportation interruption of any kind, work slowdown, transmitter or satellite degradation, failure of the Internet, interruption or failure or any other condition beyond the control of People Shop's affecting production or delivery of the Website and any information incorporated in it in any manner or any of its obligations under this Agreement.
  14. Each of the provisions of this Clause 10 shall be construed separately and independently of the others.

11. DISPUTES

  1. Should Customers or Associates have a dispute with another Customer or Associate, they must, in the first instance, address such dispute directly to the Customer or Associate concerned and feedback the results to People Shop.
  2. PeopleShop may at its sole discretion without being under legal obligation to do so, investigate any grievances held by Customers or Associates, and may discuss any investigation with all involved parties. However there are only three possible outcomes of a grievance investigation:
    1. a Customer or Associate may be allowed to continue using the Services of People Shop;
    2. a Customer or Associate may be Suspended from using the Services of People Shop for a period of time, at the discretion of People Shop;
    3. a Customer or Associate may be banned indefinitely from using the Services of People Shop.
  3. You hereby agree to release People Shop from any damages or claims (including punitive, consequential and incidental damages) of every kind or nature, suspected and unsuspected, known and unknown, and disclosed or undisclosed, arising out of or in any way connected with such disputes.

12. SUSPENSION AND TERMINATION

  1. People Shop reserves the right to Suspend or discontinue its Service to individual Customers or Associates, with immediate effect, as it sees fit and in circumstances including, but not limited to:
    1. where People Shop has not received the required information from Associates as part of its registration process.
    2. where payments that are due have not been settled as defined by The Companies Payment Terms.
    3. where People Shop suspects that a Customer or Associate is in material breach of any term hereof.
    4. as a result of People Shop exercising its discretion following a grievance investigation under clause 11, above.
  2. Either party may terminate this Agreement forthwith by written notice if the other commits any material breach of any term hereof and which (in the case of a breach capable of being remedied) shall not have been remedied within 30 days of a written request to remedy the same.

13. GENERAL

  1. Clause headings are inserted for convenience only and shall not effect the construction hereof.
  2. If any provisions hereof are held to be illegal or unenforceable such provisions shall be severed and the remainder of this Agreement shall remain in full force and effect unless the business purpose of this Agreement is substantially frustrated thereby. For those provisions severed in accordance with this clause People Shop reserves the right to replace such provisions with an alternative provision which is legal and enforceable and matches as closely as reasonably possible the intention of the original provision.
  3. You may not assign, transfer or sub-contract any of its rights hereunder without the prior written consent of People Shop. People Shop may assign, transfer or sub-contract all or any of its rights at any time without your consent.
  4. Any express or implied waiver by People Shop of any term or condition hereof or any breach or default by you may be terminated by People Shop at any time. No such waiver shall constitute a continuing waiver nor shall it prevent People Shop from acting upon that or any subsequent breach or default or from enforcing any term or condition hereof.
  5. This Agreement constitutes the entire agreement between People Shop and you as to the subject matter hereof and supersedes all previous communications, representations and arrangements, either written or oral (other than fraudulent misrepresentation). You acknowledge that no reliance is placed on any representation made but not embodied herein.
  6. The provisions of Clauses 1, 2, 3, 4, 8, 10, 11, 12, and 13(f) shall survive termination of this Agreement.
  7. Any notice to be given under this Agreement may be given via E-mail, regular mail, facsimile or by hand to the address provided on the Website or otherwise as notified by one party to the other.
  8. No terms or conditions other than those set forth herein or any variation thereof shall be binding upon People Shop, unless in writing and signed on behalf of both authorised representatives of People Shop and You.
  9. Nothing herein shall create or be deemed to create any joint venture, principal-agent or partnership relationship between the parties and neither party shall hold itself out in its advertising or otherwise in any manner which would indicate or imply any such relationship with the other.
  10. This Agreement shall be subject to the laws of England and Wales and the parties shall submit to the exclusive jurisdiction of the English courts.

PEOPLE SHOP PAYMENT TERMS

In addition to this website's Terms & Conditions which govern your use of this website, any purchase of services by You from this website is also governed by these additional Payment Terms.

In these Payment Terms:

  • "People Shop" means – People Shop Ltd (registered company number: 05780015) whose registered office is at 5 Jupiter House, Cavella Park, Aldermaston, Reading, Bucks. RG7 8NN including where the context so allows, its shareholders, employees, affiliates, associated and contracted persons, companies or businesses supplying services to People Shop;
  • "You" means – the Associate or Customer, utilising the Services, as the context requires.
  • "Associates(s)" means – a person, persons or companies registered as such with People Shop.
  • "Customer(s)" means – a person, persons or companies registered as such with People Shop.
  • "Job(s)" or "Work" means - work carried out by Associates on behalf of Customers.
  • "Website" means - the web space, pages, and the contents and graphics contained in such space or pages which are under the editorial control of authorised members of People Shop including www.peopleshop.co.uk and all associated web pages.

1. AGREEMENT

  1. It is possible that the Associate's price may have changed from that posted on The Website. Acceptance of the booking is at the Associate's discretion and People Shop is not responsible and cannot be held liable for any inaccuracies.
  2. The Customer agrees to pay the charge for the Services from the payment information they supplied to the Website. The Customer authorises People Shop to arrange withdrawal of funds on this information without further reference to you, following acceptance of the booking by the Associate.
  3. The Associate’s acceptance of the booking constitutes their authorisation to pay the applicable Booking Fee and the Registration Fee if the Job is their first Job since registering.
  4. If People Shop makes any changes to the provision of Services, which involves action on The Customer or Associates part, and The Customer or Associate do not take that action, People Shop are entitled to Suspend the Services to you without notice.
  5. People Shop cannot confirm a booking until both the Customer and Associate have provided the necessary authorisation of the booking fee in full. Upon receipt of such authorisation, People Shop will confirm receipt of the booking by an acknowledgement displayed onscreen, followed by an e-mail which will be sent to the relevant e-mail addresses supplied by the Customer and Associate. Although payment authorisation is required prior to booking, People Shop will not claim payment until the earlier of:
    1. the first day of the job booked, or
    2. the latest date authorised by your chosen payment mechanism
  6. People Shop reserves the right to choose not to facilitate your booking for any reason, at its discretion, and will not be liable to You or anyone else in those circumstances. No Booking Fee will be payable in such circumstances.

2. PRICES AND PAYMENT

  1. As a Customer, you agree to pay the applicable Booking Fee to People Shop upon People Shop's confirmation of the booking with the applicable Associate. The payment, to the Associate for the Work booked is a matter for direct agreement between you and the Associate.
  2. As an Associate, you agree to pay fees, including but not limited to:
    1. Registration Fee, which is payable upon completion of your first Job,
    2. Membership Fee, which is payable on the 12 month anniversary of registration
    3. ("Anniversary Date") unless the Associate notifies People Shop of their desire to cease to be a member of People Shop, such notice to be received no less than one month prior to the Anniversary Date, and
    4. Booking Fee, which is payable on acceptance of each booking.
  3. The latest values of the above fees are identified at People Shop Charges, all prices are in Pounds Sterling (GBP £), inclusive of VAT.
  4. Time is of the essence and failure to pay any fees properly due in accordance with these Payment Terms may result in Suspension or Termination of Services to Associates or Customers in accordance with the People Shop Terms and Conditions.
  5. People Shop have decided not to handle any online transactions ourselves, we rely on PayPal to do this for us. PayPal will take your transaction and process it securely and then deposit the money in the appropriate account, we will then be notified of the successful transaction. 3. YOUR RIGHT TO CANCEL

4. AGE REQUIREMENTS

  1. No person under the age of 18 may book or offer Work via People Shop's Website or its Services.
  2. If a higher minimum age requirement is indicated for particular Job's, You must confirm that You are of the required age before You will be able to proceed with the booking. We reserve the right not to honour any booking where we reasonably believe that You are below the relevant minimum age.

5. GENERAL

  1. People Shop may change these Payment Terms at any time, provided that any such change will not affect any booking You have made before the change is implemented. The Payment Terms currently in effect are those published on this website.
  2. These People Shop Payment Terms remain at all times subject to the People Shop Terms and Conditions

PEOPLESHOP.CO.UK CONDITIONS OF USE

  • The Peopleshop.co.uk website is made available to you by People Shop Limited ("People Shop"), a limited company incorporated in England and Wales (Registration Number 05780015) with its registered office at Jupiter House, Calleva Park, Aldermaston, Reading, Berkshire, RG7 8NN, United Kingdom.
  • Peopleshop.co.uk may also contain data supplied by third parties.

1. THESE CONDITIONS

  1. For the purpose of these conditions, "Website" means - the web space, pages, and the contents and graphics contained in such space or pages which are under the editorial control of People Shop including www.peopleshop.co.uk and all associated web pages.

You are allowed to use the Website and the results of any search made on the Website for this purpose unless such use is prohibited by paragraph 9 below.
  2. Please be aware that People Shop takes active measures to ensure that no unauthorised or prohibited use is made of the Website and that People Shop's intellectual property rights are not infringed.
  3. The following uses of the Website are prohibited:
    1. agree not to use the Website or the Services to transmit or post any chain letters or any material for the purposes of publicity, promotion and/or advertising;
    2. agree not to use the Website or the Services to distribute by any means computer viruses or worms to Customers, Associates or Third Parties;
    3. agree not to use the Website to attempt any unauthorised access to any part or component of the Website or that of any Third Party or Member to which you can connect via the Website (or other directly or otherwise connected network);
    4. agree not use the Website or Services as source of targeting material or contact data for any kind of telemarketing, direct marketing, viral or other electronic marketing activity on your own behalf or on behalf or for the benefit of a Third Party;
    5. agree not to bypass measures we may use now or in the future to prevent or restrict access to the Website or certain information contained therein;
    6. using the Website for any purpose which is unlawful in the United Kingdom and, if the Website is accessed from outside the United Kingdom for any purpose which is unlawful in the jurisdiction from which such access is made;
    7. using the Website or the Services for any purpose that is: harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, invasive of another's privacy, or is (in People Shop’s reasonable opinion) otherwise objectionable;

  1. You use the Website at your own risk. People Shop advises users to satisfy themselves as to the exact type and nature of:
    1. services being displayed, referred to or offered through the Website; and/or
    2. the qualifications held by those persons, companies and other organisations whose services may be displayed, referred to or offered through the Website. People Shop is not an agent for and does not vouch for those persons, companies and/or other organisations whose services may be displayed or referred to on the Website.
  2. The Website may make available to you certain information provided by third parties and you should not rely on it as advice for any purpose whatsoever.
  3. Insofar as the applicable laws will allow, no advice or information given by People Shop or any of its officers, shareholders, employees, affiliates, agents, or the like, (collectively, "People Shop Personnel") will create a representation, a warranty, undertaking or other commitment to you, either express or implied as to the accuracy, content, timeliness, completeness, legality, reliability, quality, fitness for purpose or suitability of any information, advice, content, service, search results, goods, services, products or merchandise provided by or through the Website. People Shop Personnel make no representation, warranty, undertaking or other commitment to you, either express or implied:
    1. that the use of the Website will be uninterrupted or error-free; or
    2. that either of the Website or the computer server(s) from which the Website is made available, is free of viruses or other harmful components.

4. LIMITATION OF LIABILITY

  1. Neither the People Shop Personnel nor their associated content provider organisations seek to limit or exclude liability for death or personal injury arising from their negligence or for fraud.
  2. Under no circumstances will the People Shop Personnel or any other party involved in the creation, production, maintenance or distribution of the Website, be liable for any: (a) loss of profits; (b) loss of business or business opportunities; (c) loss of anticipated savings; (d) loss of goodwill; (e) loss of use of data; (f) loss of data; (g) other intangible losses; or (h) any indirect, incidental, special or consequential loss or damages whether based on breach of contract, tort (including negligence), product liability or otherwise, which results from:
    1. the use of and/or reliance on the Website;
    2. the inability to use the Website;
    3. any mistake, omission, defect, virus or failure of performance with respect to the Website including (without limitation) those which arise from acts of God, communications failure, theft, destruction and/or unauthorised access to People Shop's records, programs or services;
    4. merchandise, products, services or information received through or advertised on the Website or any links provided by the Website; and/or
    5. any information, data, message or other material which you email, post, upload, reproduce, transmit or is otherwise distributed or received using the Website.

5. GENERAL

  1. These Conditions of Use remain at all times subject to the People Shop Terms and Conditions which are incorporated by reference herein.

PEOPLESHOP CANCELLATION POLICY

People Shop offers a directory matching and booking service which links people looking for skills and services with people who can provide them, enabling Customers to select and contract with the Associate of their choosing.

Due to the nature of the services we provide, People Shop is not a party to the contract for the provision of services from an Associate to a Customer and cannot accept any liability for any act or omission within that contract including any damages which may be incurred by one party, due to the cancellation of the other (see our Terms and Conditions for more details).

People Shop is however committed to providing an outstanding service to our users and we have therefore adopted this cancellation policy which applies to all bookings.

If a booking has been accepted and one of the parties to the booking wishes to amend the arrangements (e.g. vary date, time or location) then we recommend you contact the Associate/Customer directly as we will have provided all relevant contact details at the time of confirming the booking. If revised arrangements cannot be agreed then you can only cancel the booking via the People Shop website and the following will apply.

People Shop regret that we are unable to refund the Booking Fees paid by the Customer / Associate who cancels the booking.

Without accepting any liability for the cancellation, People Shop offers as a gesture of goodwill to refund the booking fee paid by the Associate / Customer who did not cancel the booking. Under these circumstances we will contact the relevant Associate / Customer using the email address provided during registration to obtain their preferred account for receiving this refund. Refunds will only be provided via PayPal and must be requested within 14 days of the relevant cancellation.

In the event that a booking is not cancelled via our Website but the service is still not provided (e.g. failure to attend by Associate / Customer) we regret that we can accept no liability for this failure which is a matter for the Associate and Customer to resolve directly. Under these circumstances no Booking Fee can be refunded, we would however recommend that you;

  • Use the rating service on our Website to identify your dissatisfaction as we believe that through this route this rating service is the best possible way to ensure individuals are motivated to contact each other directly and agree appropriate measures in a professional and courteous manner
  • Contact us to identify the circumstances around the incident so that if we consider it appropriate, at our sole discretion, we may Suspend the Associate's / Customer's use of our Services in accordance with our Terms and Conditions or take any other steps available to us at our absolute discretion
